Guam labor laws do not mandate any specific format, type or mandatory clauses for employment contracts. An employment relationship may be established via written, verbal or implied agreements.
The at-will employment doctrine generally applies to the private sector. Unless otherwise stipulated in an employment contract, collective bargaining agreement or employer policy, both employers and employees may terminate the employment relationship without prior notice or stated reason.
Nevertheless, all parties remain subject to mandatory statutory laws including anti-discrimination regulations and minimum labor standards.

Notes: There is no statutory requirement for compensatory rest if a public holiday falls on an employee’s regular rest day.

Annual Leave
No statutory minimum annual leave standards. Eligibility, duration, and paid leave allowances are governed by employment contracts, collective bargaining agreements, or employer internal policies.
Federal Family and Medical Leave Act (FMLA, U.S. Federal)
Qualifying Events:
Eligibility:
The employer employs 50 or more employees during any 20 weeks within the current or preceding calendar year;
The employee has completed 12 consecutive months of service with the employer, logged a minimum of 1,250 working hours in the prior 12 months, and the employer maintains a workforce of 50+ employees within a 75-mile radius of the worksite.
Duration:
Military caregiver leave: Up to 26 weeks within any 12 months;
All other FMLA leave types: Up to 12 weeks within any 12 months.
Allowance:
Unpaid leave. Employees may elect to use accrued employer-provided paid leave concurrently, or may be required by the employer to exhaust available paid leave first.
Guam Local Family and Medical Leave
Qualifying Events:
Eligibility:
The employer employs 20 or more staff within Guam;
The employee has completed 12 consecutive months of service with the employer and worked a minimum of 1,000 hours in the prior 12 months;
The employee provides written notice to the employer at least 30 days in advance;
The employer may request supporting medical documentation.
Duration:
Up to 12 weeks within any 12 months.
Allowance:
Unpaid leave. Employees may opt to substitute accrued annual leave, other paid time off, or sick leave (only for the employee’s personal illness) for family and medical leave, or the employer may mandate such substitution.
Notes: Employees generally cannot claim two separate blocks of family and medical leave under both federal and Guam local statutes; a single leave period shall count against both leave entitlements concurrently.

Effective 1 September 2021, the statutory minimum wage in Guam is USD 9.25 per hour.
Upon involuntary dismissal, the employer shall immediately disburse all earned wages to the employee. For voluntary resignation, all accrued earned wages shall be paid on the next regular scheduled payroll date.
